1. Introduction

GetStorageSpace ("we", "us", "our") operates a marketplace platform that connects individuals and businesses seeking self-storage solutions ("Customers") with independent self-storage facility operators ("Operators"). By using our website and services, you agree to these Terms of Service.

2. Nature of Our Service

GetStorageSpace is an introductory service only. We do not own, operate, manage, or control any storage facility listed on our platform. We act solely as an intermediary, facilitating introductions between Customers and Operators. We do not provide storage services, and we are not a party to any agreement between Customers and Operators.

3. Limitation of Liability

To the maximum extent permitted by applicable law, GetStorageSpace shall not be liable for:

  • The quality, safety, legality, or suitability of any storage facility listed on the platform
  • The conduct, performance, or reliability of any Operator
  • Any loss, damage, theft, or deterioration of items stored at any facility
  • Any disputes, claims, or disagreements between Customers and Operators
  • The accuracy of information provided by Operators, including pricing, availability, or facility descriptions
  • Any indirect, incidental, consequential, or punitive damages arising from use of our platform

Our total liability to you for any claim arising from or related to our services shall not exceed the amount of the deposit you paid through our platform. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

4. Reservation Deposit

When a Customer confirms a booking through our platform, a reservation deposit is collected. This deposit serves as a commitment fee and must be credited by the Operator towards the Customer's first month's rent. The deposit amount varies by market (e.g., $65 in Canada, £50 in United Kingdom, €55 in France). Deposits are generally non-refundable once the introduction between Customer and Operator has been facilitated.

Operator obligation:By listing on GetStorageSpace and submitting quotes, Operators expressly agree to credit the full reservation deposit amount against the Customer's first month's rent. This obligation is a binding condition of using the platform. Failure to credit the deposit constitutes a breach of these Terms and may result in removal from the platform.

5. Customer Responsibilities

  • Customers must independently verify the suitability of any storage facility before entering into an agreement with an Operator
  • Customers are responsible for inspecting facilities, understanding lease terms, and obtaining adequate insurance for stored items
  • Customers must provide accurate and truthful information when submitting storage requests
  • Any contractual relationship for storage services is solely between the Customer and the Operator

6. Operator Responsibilities

  • Operators are solely responsible for the accuracy of their facility listings, including pricing, availability, and descriptions
  • Operators must comply with all applicable local laws and regulations governing self-storage operations
  • Operators are responsible for the security, maintenance, and condition of their facilities
  • Operators agree to honour quotes submitted through the platform in good faith
  • Operators agree to credit the customer's reservation deposit in full against the customer's first month's rent

7. Data and Privacy

Your use of our platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the EU GDPR, UK GDPR, and other applicable data protection laws. Customer contact details (email, phone) are kept anonymous until a booking deposit is confirmed, at which point they are shared with the selected Operator to facilitate the storage arrangement.

8. Consumer Rights

If you are a consumer in the European Economic Area or the United Kingdom, you have statutory rights under consumer protection laws that cannot be waived by these Terms. Nothing in these Terms affects your rights under the Consumer Rights Act 2015 (UK), the Consumer Contracts Regulations 2013 (UK), or equivalent EU consumer protection legislation in your country of residence.

Right of withdrawal:Since our service consists of facilitating an introduction between Customer and Operator, the service is considered fully performed once the Operator's contact details are released following deposit payment. By paying the deposit, you acknowledge and agree that the introductory service is completed immediately, and you waive the 14-day cooling-off period to the extent permitted by applicable law.

9. Disclaimer of Warranties

Our platform and services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure. We make no representations about the quality or reliability of any Operator or storage facility listed on our platform.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless GetStorageSpace, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these terms, or any dispute with a Customer or Operator. This clause does not apply to consumers where prohibited by law.

11. Governing Law and Jurisdiction

For users in the United Kingdom: These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also bring proceedings in the courts of the country where you reside.

For users in the European Union: These Terms shall be governed by the laws of the EU member state in which you are habitually resident, in accordance with the Rome I Regulation (EC) No 593/2008. You may bring proceedings in the courts of your country of residence. You also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

For users in the United States: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware. Nothing in these Terms limits your rights under applicable state consumer protection laws.

For all other users: These Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on our website. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the platform.
